A former xAI engineer filed a lawsuit in California this week, alleging Elon Musk‘s companies fired him for sounding the alarm on safety flaws in the Grok AI chatbot. Devin Kim claims he was a leading internal advocate for stronger safeguards against dangerous outputs, including content that could facilitate bioterrorism.
According to the complaint filed in Santa Clara County Superior Court, Kim repeatedly pushed for more rigorous testing to prevent misinformation and racial bias. Consequently, his termination allegedly violated California labor laws and public policy designed to protect whistleblowers. “This case is about more than one employee’s termination. It is about whether people closest to the development of powerful AI technologies can raise safety concerns without risking their careers,” said his lawyer in a statement.
The lawsuit points to public incidents as validation of Kim’s internal warnings, including Grok’s antisemitic “MechaHitler” meltdown last summer. It also cites more recent investigations and lawsuits tied to Grok’s alleged generation of nonconsensual sexual deepfake imagery.
Meanwhile, the case emerges during a pivotal period for Musk’s business empire as SpaceX prepares for its anticipated initial public offering. Kim, who was named president of the nonprofit Center for AI Safety earlier this month, is seeking restoration of forfeited equity and compensatory damages.
