Crypto lawyer James Murphy has filed a Freedom of Information Act (FOIA) lawsuit against the US Department of Homeland Security (DHS), seeking to force the agency to disclose what it may know about the creator of Bitcoin. Filed on April 7, the lawsuit aims to obtain documentation related to claims that DHS agents previously met with four individuals involved in Bitcoin’s creation.
Murphy, known as MetaLawMan on social media platform X, based his legal action on statements made by DHS Special Agent Rana Saoud at a 2019 conference in Miami. "My FOIA lawsuit simply asks for the notes, email and other documents relating to that alleged interview," Murphy posted on X after filing the suit.
During her presentation at the OffshoreAlert Conference North America in April 2019, Saoud claimed that DHS agents traveled to California to meet with four people believed to have created Bitcoin. According to her recorded statements available on YouTube, the agents sought to understand their motives and Bitcoin’s "end game." Murphy has committed to pursuing the case to conclusion if the DHS resists disclosure.
Legal Approach and Potential Outcomes
The lawsuit, filed with assistance from former Assistant US Attorney Brian Field, a FOIA litigation specialist, acknowledges the possibility that Saoud and other DHS agents may have been mistaken about interviewing the real Satoshi Nakamoto. The Freedom of Information Act serves to promote government transparency by granting public access to government-held information.
Continuing Mystery of Satoshi’s Identity
This legal effort follows several unsuccessful attempts to uncover who created Bitcoin. Last October, an HBO documentary suggested that Bitcoin cypherpunk Peter Todd was Satoshi Nakamoto, a claim Todd himself denied. Other notable figures including Nick Szabo, Adam Back, and the late Hal Finney have also been linked to Bitcoin’s creation, with most denying the association.
The Bitcoin community remains divided on whether revealing Satoshi’s identity would benefit the cryptocurrency. Some community members fear that uncovering Satoshi could compromise Bitcoin’s decentralized nature and potentially put the creator at risk, while others seek reassurance that Bitcoin wasn’t created by the US government.
