Trump Imposes New Global Tariff After Court Defeat

Supreme Court voids Trump tariffs; he swiftly enacts new universal 10% global tariff.

  • The U.S. Supreme Court struck down President Trump’s emergency tariffs on February 20, 2026, ruling the president lacked legal authority.
  • Trump responded within hours by signing a new executive order imposing a universal 10% global tariff under a different statute.
  • Importers have paid roughly $134 billion under the now-invalidated tariffs, creating a major refund question for over 301,000 companies.
  • The new flat tariff significantly alters the rates for major trade partners like China and BRICS nations, at least temporarily.
  • Treasury Secretary Scott Bessent stated the administration’s combined tariff tools will keep revenue “virtually unchanged” for the year.

In a dramatic constitutional standoff, the U.S. Supreme Court invalidated President Trump’s emergency tariffs on February 20, 2026. Chief Justice John Roberts wrote that Congress did not grant the clear authority required for such actions. However, the administration moved swiftly, with Trump signing a new executive order within hours to levy a fresh 10% duty on all nations.

Trump called the court’s ruling “deeply disappointing” and expressed shame towards certain justices. He further labeled the opposing justices as “fools and lapdogs” during a White House briefing. Meanwhile, the President asserted that powerful statutory alternatives remained available to him.

Consequently, the trade dynamic with China and BRICS members like India and Brazil has shifted immediately. The previous combined tariff rate on China falls from 45% to 35% under the new universal framework. This policy volatility may accelerate existing BRICS initiatives aimed at reducing dollar dependency in global trade.

A massive financial question now looms over approximately $134 billion in previously collected duties. Importers from more than 301,000 companies had paid these sums under the overturned legal authority. Treasury Secretary Scott Bessent later claimed the administration’s toolkit would sustain federal tariff revenue for 2026.
