US Attorney Jay Clayton has formally requested a retrial for Tornado Cash developer Roman Storm on charges of conspiracy to commit money laundering and violate sanctions, according to its filing. The proposed trial window spans October 5-12, 2026, continuing the high-profile case against the crypto mixing service developer. Clayton confirmed via a letter posted on X that prosecutors will pursue Count 1, a money laundering conspiracy allegedly involving over $1 billion, and Count 3, a sanctions violation conspiracy.
Count 1 alleges Storm knowingly helped criminals conceal funds, including hundreds of millions from a hack by North Korea‘s Lazarus Group. However, jurors deadlocked on these counts, making the case a partial mistrial.
Count 2 involved a conspiracy to operate an unlicensed money-transmitting business, which a jury previously convicted Storm on in August 2025. Storm filed a Rule 29 motion challenging the legal sufficiency of evidence for that conviction, with a ruling expected as early as April 9, 2026. His attorney Brian Klein said after the first trial that he expected “full vindication.”
Meanwhile, Count 3 alleges Storm kept operating Tornado Cash after the U.S. Treasury sanctioned the protocol in August 2022. Consequently, the defense continues its fight on First Amendment and evidence grounds. Storm remains free on a $2 million bail while awaiting critical court decisions later this year.
