Judge Engelmayer approved the delay, rescheduling the hearing from June 12 to a new date during the week of June 23.
The legal teams described the ongoing discussions as “productive” and stated that more time could help avoid filing certain pre-trial motions. These motions often include requests to dismiss charges, attempts to suppress evidence, or requests to change the trial venue, according to the United States Department of Justice’s pre-trial motions guide.
Previous delays in this case have occurred. U.S. prosecutors earlier asked for more time so Do Kwon’s lawyers could review approximately four terabytes of new evidence. In April, Judge Engelmayer rescheduled the trial for February 17 of the following year after prosecutors confirmed that a Department of Justice memo on closing a crypto enforcement unit would not affect the charges against Do Kwon.
Do Kwon had remained in Montenegro for several years due to ongoing extradition issues, a situation sometimes called "extradition limbo." He was finally extradited to the United States on December 31, 2024, where he pleaded not guilty to nine federal charges. These charges involve securities fraud, conspiracy to commit money laundering, and other financial crimes connected to the collapse of Terraform Labs.
The latest hearing postponement follows a series of similar delays as both sides continue legal discussions.
